SplitSeasonTickets Specialized Site Service Terms of Use

The Detroit Red Wings (the "Red Wings"), National Hockey League ("NHL"), and SplitSeasonTickets, LLC ("SST") welcome you to use the ticket draft service (the "Service") located on a Subsite of Red Wings.com . The terms set forth below (the "Agreement") govern your use of this subsite ("Subsite"). By using or visiting the Subsite, you expressly agree to be bound by this Agreement and to follow all terms and applicable laws and regulations governing the Subsite. If you do not agree with this Agreement, your sole recourse is not to use the Subsite.

1. Priority. This Agreement, in combination with the general Terms of Use (available at http://www.NHL.com/news/termsofuse.html) and the general Privacy Policy (available at http://www.NHL.com/news/privacy_policy.html) that are applicable to http://www2.nhl.com/Red Wings/ users, set forth the terms and conditions under which the Red Wings, NHL, and SST makes the Subsite available to you.

2. Proper Use. The content and software on this Subsite is the property of Detroit Red Wings, NHL, and SST and is protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not distribute, copy, reproduce, alter, modify, translate, rebroadcast, transmit, perform or create derivative works, publicly display or otherwise use any content (except for your own personal, non-commercial use) from the Subsite. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor, copy or otherwise take any content from the Subsite. Furthermore, the Subsite is provided to you for your own personal use, and it may not be used for any commercial purposes or any fraudulent or illegal purposes.  Any use of the Subsite that infringes upon Detroit Red Wings, NHL, and/or SST's intellectual property rights or that is for commercial purposes or fraudulent or illegal purposes will be investigated and Detroit Red Wings, NHL, and/or SST shall have the right to take appropriate civil and criminal legal action. The Services are subject to transmission limitations of the Internet and, as applicable, wireless carriers, including, but not limited to, video and/or audio dropouts, rebuffering or loss of connection.

3. User Contributions and Privacy. There are many opportunities within the Subsite for you to actively participate. In the process of doing so, you may provide certain personal information, preferences, comments, suggestions, data, or other information to the Red Wings, NHL, and SST (collectively "Information"). Detroit Red Wings, NHL, and SST shall have the right to retain and use any such Information in current or future products or services, without further compensation or notice to you.

Each of the Red Wings, NHL and SST reserves the right to modify the Service. Neither the Red Wings, NHL nor SST is  responsible for any error in copy or images relating to the Service. Any a feature of the Service may be discontinued at any time.

4. No Warranty. USE OF THE SUBSITE ANDTHE SERVICEIS AT YOUR EXCLUSIVE RISK, AND THE RISK OF INJURY FROM THE FOREGOING RESTS EXCLUSIVELY WITH YOU.   The SUBSITE provides users with a service that makes is easier for groups of people who share ownership of season tickets to distribute the games and tickets in a season.  The Service has been extensively tested but THERE IS NO GUARANTEE THAT THE SERVICE CAN WORK PERFECTLY FOR YOU AND YOUR GROUP. IF YOU ARE CONCERNED THAT THE SERVICE MAY NOT WORK FOR YOUR GROUP, THEN YOU SHOULD NOT USE THE SERVICE. ACCORDINGLY, THE SUBSITE IS PROVIDED "AS IS" WITH NO WARRANTY OF ANY KIND AND YOU USE THE SERVICE AT YOUR OWN RISK. NONE OF THE Red Wings, NHL OR SST  WARRANTS THAT: (A) THE WEBSITE, THE SUBSITE, OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; (B) DEFECTS OR ERRORS IN THE WEBSITE, SUBSITE, SERVICE OR SOFTWARE  WILL BE CORRECTED; (C) THE WEBSITE, THE SUBSITE  OR THE SERVICE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;  (D) ANY INFORMATION CONTAINED IN THE SUBSITE, OR THE SERVICE WILL BE ACCURATE OR RELIABLE,  (E) THE SUBSITE OR THE SERVICE WILL MEET YOUR REQUIREMENTS, OR (F) THE QUALITY OF THE SUBSITE, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SUBSITE WILL MEET YOUR EXPECTATIONS, THE Red Wings, NHL, AND SST EACH EXPRESSLY DISCLAIMS (AA) ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SUBSITE, ITS CONTENT AND/OR THE SERVICE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OR (BB) ANY RESPONSIBILITY OR LIABILITY FOR ANY DAMAGE, LOSS OR INJURY ARISING OUT OF: THE ACTIVITIES OF ANY VENDOR OR USER OF THE SERVICE, , ANY LOSS OR INJURY RESULTING FROM YOUR ACCESS OR INABILITY TO ACCESS THE WEBSITE, THE SUBSITE OR THE  SERVICE, OR ANY LOSS OR INJURY ARISING OUT OF YOUR  USE OF THE SERVICE. Some states do not allow the exclusion of warranty, so the above exclusions may not apply to you.

5. Limitation of Liability. YOU EXPRESSLY UNDERSTAND AND AGREE THAT the Red Wings, NHL, and/or SST SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF the Red Wings, NHL, and/or SST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SUBSITE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SUBSITE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SUBSITE; OR (v) ANY OTHER MATTER RELATING TO THE SUBSITE OR THE USE OF THE SUBSITE BY ANY PARTY.

UNDER NO CIRCUMSTANCES SHALL the Red Wings, NHL, and/or SST BE LIABLE TO YOU FOR ANY AMOUNT. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusions may not apply to you.

6. Release and Waiver. To the maximum extent permitted by applicable law, you hereby release, and waive all claims against the Red Wings, NHL, and SST and their respective owners, members, shareholders, affiliates,  employees, agents and representatives from any and all liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorneys' fees) of every kind and nature, arising out of or in any way connected with use of the Subsite.

7. Modifications of Terms. The Red Wings, NHL, and/or SST shall have the right to modify the terms of this Agreement at any time, which modification shall be effective immediately upon posting to the Subsite. Accordingly, we suggest that you check this page periodically. To make your review more convenient, we will post a version number or date at the bottom of this page.

8.  Modification of Service. Programming, pricing, terms and conditions of the Service are subject to availability and change. The Red Wings, NHL and SST may change, suspend or discontinue any aspect of the Subsite at any time, including the availability of the Subsite or its content.

9. Violations of Terms; Termination

The Red Wings, NHL and SST may impose limits on certain features of the Service or restrict your access to parts or the entire Subsite without notice or liability at any time , without prejudice to any legal or equitable remedies available to each of them, for any reason or purpose, including, but not limited to, conduct that the Red Wings, NHL or SST believes violates this Agreement or other policies or guidelines posted on the Website or conduct which the Red Wings, NHL or SST believes is harmful to other customers.. In addition, this Agreement may be immediately terminated at any time by the Red Wings, NHL and SST in their sole discretion. In addition and without prejudice to any other remedy available to the Red Wings, NHL or SST the Red Wings, NHL and SST may immediately terminate this Agreement if you breach any term of this Agreement or the rules of use for the Service. In addition to any legal remedies that the Red Wings, NHL, and/or SST may have for your violation of the terms of this Agreement, the Red Wings, NHL, and/or SST shall also have the right in its sole discretion to suspend or terminate your access to the Subsite.

10. Hold Harmless and Indemnity. You agree to hold harmless and indemnify the Red Wings, NHL, and SST, and their respective owners, members, shareholders, affiliates,  employees, agents and representatives, from and against any third party claim arising from or in any way related to (A) your use of the Subsite or the Service, or (B) any alleged breach of this Agreement by you.

11. Miscellaneous

This Agreement constitutes the entire agreement between the parties, and supersedes all prior written or oral agreements or communications with respect to the subject matter herein. Sections 5, 6,10, 11 and 12 of this Agreement will survive any termination or cancellation of this Agreement. If any term in this Agreement is declared unlawful, void or for any reason unenforceable by any court, then such term will be deemed severable from the remaining terms and will not affect the validity and enforceability of such remaining terms. The section headings in this Agreement are for convenience only and must not be given any legal import.

12. Acceptance of Terms of Use

BY USING THE WEBSITE, YOU SIGNIFY YOUR AGREEMENT TO THE TERMS OF THIS AGREEMENT. If you do not agree to the terms in this Agreement, you must not use the Website. NHL may change the terms of this Agreement at any time, and your use of the Website after such changes are posted will mean that you accept them.
